The Legal Status of 7-OH 

7-OH is a substance found in trace amounts in the kratom plant. Concentrated and synthetically produced 7-OH products contain much higher amounts of 7-OH and produce opioid-like effects. In recent years, 7-OH is being sold legally all over the US, with severe adverse effects reported. Several states and local governments have taken steps to restrict the product, and now, the federal government is taking action.

The federal government has taken steps to schedule 7-OH, and the rule is set to take effect on or after August 5, 2026.   

The DEA moves to schedule 7-OH  

On July 1, the DEA filed a notice of intent to temporarily schedule 7-OH. The document was published in the Federal Register on July 6, and it says that the DEA intends to schedule 7-OH  on or after August 5, 2026. When finalized, the rule would make 7-OH a federally controlled Schedule I drugs, and included 7-OH products will be illegal in the United States. 

What 7-OH substances are being scheduled? 

Synthesized 7-OH products and products containing elevated concentrations of 7-OH above a specific threshold will be banned. Botanical kratom products which contain naturally occurring 7-OH below a specific threshold will remain legal, though it may be subject to state or local regulations 

The proposal covers: 

  • Botanical kratom material containing more than 0.050% 7-OH by dry weight.  
  • Synthetic or other products containing more than 0.050% 7-OH by the applicable concentration measurement or more than 1 milligram of 7-OH per article.  
  • Processed kratom products, including extracts, concentrates, edibles and pressed pills, exceeding either applicable limit. 

Why is 7-OH being scheduled? 

The DEA, in their statement about the scheduling, says that “7-OH is a psychoactive substance with opioid-like effects and similar risks” and that they “believe these substances pose an imminent threat to public safety given their effects are highly unpredictable”.  

Will the scheduling be permanent? 

The proposed scheduling is a temporary order set to last two years and can be extended up to one year thereafter. In the interim, the Government, including the DEA, the HHS, and the FDA will be able to evaluate the substance, and undergo the full review process that a substance needs to be permanently scheduled.

Until the scheduling order takes effect, 7-OH remains legal at the federal level. However, many states have either scheduled or placed restrictions on 7-OH. Because state laws and emergency rules change frequently, readers should check current state and national law before purchasing or possessing 7-OH products.
